Difference Between a Birth Defect & Injury
Based on data from the Centers for Disease Control and Prevention (CDC), about 3% of all children in the country are born with a birth defect. The rate of birth injuries is not exactly known because the data is often confidential and/or confused with birth defects. But some estimates state that 7 in every 1,000 births might be complicated or marred by a birth injury.
Understanding the difference between a birth defect and a birth injury is an important first step for your case:
- Birth defect: A birth defect is some form of health condition suffered by a newborn child that is believed to be unpreventable and often unpredictable. For example, most heart defects suffered by a newborn are difficult to detect while the child develops, and its cause is often unplaceable. Many birth defects are believed to be caused by genetic predispositions.
- Birth injury: A birth injury is some form of harm suffered by a child or a new mother that could have been prevented, i.e., the harm that was caused or allowed by the medical professionals who assisted the mother and her child. Some birth injuries are not preventable, but it is assumed that most are.
You can file an injury claim if your child’s birth injury was preventable and caused serious harm. On the other hand, birth defects can usually not be answered with a lawsuit because medical practitioners do not cause or contribute to the risk of most birth defects.
What Compensation Can You Get?
The liable parties for a birth injury can include:
- Doctors
- Nurses
- Obstetricians
- Hospital groups
The compensation that you can secure through a birth injury claim will depend on who is liable and the consequences of the injury. Most claims seek damages to cover all past and future medical treatment costs for the mother and her child in relation to the birth injury. If the child has been permanently disabled due to the injury, then a claim can demand financial compensation that will pay for lifelong care, which can make the value of a claim significant.
Compensation can also account for the pain, suffering, and lessened enjoyment of life experienced by the child and the parents. Some parents can also receive compensation for the income they won’t earn because they have to alter their careers to take care of their injured child.
