Examples of Negligence in Jones Act Cases
In order to succeed with a Jones Act claim for personal injury an individual must prove that their employer or the ship owner was negligent in some manner that caused their injury. Here are some examples of negligence that commonly occur in Jones Act cases:
- inadequate supervision
- failure to warn of a known hazard
- failure to provide and/or maintain safe equipment and appliances
- failure to provide safety gear or follow safety rules
- inadequate instruction as to safety matters
- failure to provide appropriate medical care
- assault by another crew member/co-worker
- failure to avoid dangerous weather
- allowing an inexperienced crew member to operate equipment
- negligent hiring
- unsafe work requirements or manner of work
This list just provides some common examples of negligence. There are other ways in which an employer or ship owner can act negligently in Jones Act cases.
